Paid Annual Vacation Under the Labor Code of Albania
Vacation rights in Albania are defined in Article 92 and Article 93 of the Labor Code of the Republic of Albania:
- Minimum Paid Annual Leave: Every employee is entitled to at least 4 calendar weeks (28 calendar days, equivalent to 20 to 22 working days) of paid annual vacation per year.
- Accrual Rule: Leave accrues proportionally at approximately 2.33 calendar days per month worked.
- 14 Official Public Holidays: Albania observes 14 official national and religious holidays. If a public holiday falls on a weekend, the following Monday is designated as a paid day off.
- Prohibition of In-Service Waiver: Any contractual agreement waiving the right to annual leave in exchange for monetary compensation during ongoing employment is legally null and void.
Statutory Regulatory Framework: Compliant with Law No. 29/2023 on Income Tax, Labor Code of the Republic of Albania, Law No. 7703 on Social Insurance (ISSH), and regulatory instructions issued by the General Directorate of Taxes (DPT) and Energy Regulatory Authority (ERE).
