Severance & Termination Rights Under Antigua & Barbuda Labour Code
The Antigua and Barbuda Labour Code (Cap. 27, Division C) establishes mandatory statutory protections for employees upon termination of employment.
1. Severance Pay Formula (Section C41):
An employee who has completed at least one year of continuous service and whose employment is terminated by reason of redundancy is entitled to severance pay calculated:
- First 5 Years of Service: 1 day's basic wage for each completed month of service (equivalent to 12 days per year, or 60 days total for the first 5 years).
- Service Beyond 5 Years: 1.5 days' basic wage for each completed month of service rendered beyond the fifth year (equivalent to 18 days per year).
2. Minimum Notice Periods (Section C9):
- 1 to 5 years of service: At least 2 weeks' advance notice (or pay in lieu).
- 5 to 10 years of service: At least 3 weeks' advance notice (or pay in lieu).
- Over 10 years of service: At least 4 weeks' (1 month) advance notice (or pay in lieu).
