Capital Gains & Real Estate Alienation Taxation in Armenia
Under Article 147 and Article 150 of the Tax Code of the Republic of Armenia:
- Individual Private Residential Sales: 0.0% Personal Income Tax. When an individual sells a residential home, apartment, or land plot that was not purchased for commercial speculative activity, the entire proceeds are tax-exempt.
- Commercial Real Estate Developers & Builders: Sales of apartments in newly constructed multi-apartment residential complexes by developers are subject to 10.0% or 20.0% income tax.
- Frequent Trading (Business Activity Deemed): Selling 2 or more residential properties acquired within a 1-year period can be deemed commercial entrepreneurial activity by the SRC, triggering 10% to 20% PIT or Turnover Tax.
- Securities & Share Disposals: Gains from the alienation of corporate shares or bonds held by individuals are generally 0% tax-exempt under Article 147.
Statutory Regulatory Framework: Compliant with the Tax Code of the Republic of Armenia, Labor Code of the Republic of Armenia, Cadastre Committee statutory duties, and regulatory resolutions issued by the State Revenue Committee (SRC) and PSRC.
