Aruba Cessantia & Termination Legal Rules
Under the Landsverordening Cessantia (AB 1990 no. GT 48) of Aruba, workers whose indefinite employment contract ends through no fault of their own (such, business reorganization, or dismissal with permission from the Directie Arbeid en Onderzoek - DAO) are legally entitled to statutory Cessantia severance pay:
Years 1 through 10
1 week's pay per completed service year.
Years 11 through 20
1.25 weeks' pay per completed service year.
Years 21 and above
2.0 weeks' pay per completed service year.
Statutory Notice Periods (Burgerlijk Wetboek BW 7)
Unless a longer period is specified in a collective bargaining agreement (CAO) or contract, the statutory employer notice obligation is:
- Less than 5 years: 1 month notice
- 5 to 9 completed years: 2 months notice
- 10 to 14 completed years: 3 months notice
- 15 or more completed years: 4 months notice
