How Austrian Severance Pay Works (Abfertigung Neu vs. Alt)

Austria reformed its severance system in 2003 with the Corporate Pension Act (Betriebliches Mitarbeiter- und Selbständigenvorsorgegesetz - BMSVG):

Abfertigung Neu (Post-2003)

Employers must contribute 1.53% of your monthly gross salary starting from the second month of employment into an independent employee provision fund (Vorsorgekasse). This capital belongs to you permanently. Even if you resign voluntarily, your balance is never lost and continues to accumulate compound returns.

Abfertigung Alt (Pre-2003)

Applicable only to long-tenured contracts entered before January 1, 2003. Paid directly lump-sum by the employer based on completed tenure (from 2 up to 12 months salary). Crucial catch: If the employee resigns voluntarily (Selbstkundigung), the entire severance claim is forfeited!

Frequently Asked Questions (FAQ)

When can I withdraw cash from my Abfertigung Neu fund?

You can withdraw your capital in cash if: (1) You have at least 3 contribution years (36 months across all employers), AND (2) You were dismissed by your employer, terminated by mutual consent, or retired. If you quit voluntarily with less than 3 years, the money stays safely invested until a future qualifying termination or retirement.

How is severance taxed in Austria?

Under § 67 Abs. 3 EStG, statutory severance payouts are taxed at an ultra-low preferential flat rate of only 6% and are completely exempt from Austrian social security contributions!
