How Austrian Employment Notice Periods Work (§ 20 AngG)
In Austria, employment notice consists of two distinct components: the Notice Period (Kundigungsfrist) and the Termination Date (Kundigungstermin).
Kundigungsfrist (The Duration)
The required timeframe that must elapse between the receipt of notice and the end of the contract. For employees quitting, it is 1 month. For employers dismissing, it ranges from 6 weeks up to 5 months based on completed years of service.
Kundigungstermin (The Target Date)
Under statutory law, an employer termination can only take effect at the end of a calendar quarter (31 March, 30 June, 30 September, 31 December). However, most written employment contracts agree to make the 15th or the end of each calendar month an eligible termination date.

What happens if the employer sets an incorrect termination date (Kundigung zur Unzeit)?
If the employer serves notice with too short a duration or to the wrong date, the termination is still legally effective, but you are entitled to a termination indemnity (Kundigungsentschädigung): full salary and pro-rated Sonderzahlungen up to the date on which the contract should legally have ended!
