Termination & Severance Rights Under the Labor Code of Azerbaijan

Employment terminations in Azerbaijan due to staff redundancy or enterprise liquidation are governed by Article 77 of the Labor Code of the Republic of Azerbaijan:

  • Mandatory Written Notice:
    • Service up to 1 year: at least 2 calendar weeks notice.
    • Service 1 to 5 years: at least 4 calendar weeks notice.
    • Service 5 to 10 years: at least 6 calendar weeks notice.
    • Service over 10 years: at least 9 calendar weeks notice.
  • Statutory Severance Pay (Article 77, Part 3):
    • Service up to 1 year: at least 1.4 times average monthly wage.
    • Service 1 to 5 years: at least 1.4 times average monthly wage.
    • Service 5 to 10 years: at least 1.7 times average monthly wage.
    • Service over 10 years: at least 2.0 times average monthly wage.
  • Pay in Lieu of Notice: With employee consent, the employer may substitute the notice period by paying lump-sum compensation equal to the full wage for the duration of the notice period.
