Maternity & Parental Benefits in Azerbaijan
Maternity rights are protected under Chapter XIX of the Labor Code of the Republic of Azerbaijan and administered by the State Social Protection Fund (DSMF / SSPF):
- Duration of Maternity Leave (Article 125):
- Normal childbirth: 126 calendar days (70 prenatal + 56 postnatal).
- Complicated birth or multiple birth: 140 calendar days (70 prenatal + 70 postnatal).
- Agricultural sector workers: extended up to 140 to 180 calendar days.
- 100% Wage Replacement: Working mothers receive 100% of their average calculated earnings over the preceding 12 months, fully financed from the State Social Protection Fund (DSMF).
- One-Time Childbirth State Grant: A statutory lump-sum allowance of 500 AZN is paid for each newborn child.
- Partially Paid Childcare Leave: Parents may take leave to care for the child until 3 years of age, receiving monthly state benefits until age 1.5 and age 3.
Statutory Regulatory Framework: Compliant with the Tax Code of the Republic of Azerbaijan, Labor Code of the Republic of Azerbaijan, Law on Social Insurance (SSPF / DSMF), and regulatory decrees issued by the State Tax Service, Tariff (Price) Council, and State Customs Committee.
