Statutory Conveyance VAT & Customary Practice
Property transfers in The Bahamas are governed by the Value Added Tax Act (which replaced the old Stamp Duty regime on conveyances):
- Consideration ≤ BSD$100,000: 2.5% VAT.
- Consideration > BSD$100,000: 10.0% standard VAT on the full transaction amount.
- First-Time Bahamian Home Buyers: Fully exempt from conveyance VAT on owner-occupied residential properties up to BSD$300,000. For properties between $300k and $500k, VAT applies only to the excess over $300k.
- 50/50 Customary Split: By standard Bahamian real estate practice, buyer and seller split the government conveyance VAT equally (50% each), unless otherwise negotiated in the purchase agreement.
- Bahamas Bar Legal Scale: Legal conveyancing fees are standardly 2.5% on the first $500,000, 2.0% on the next $500,000, and 1.0% on any balance over $1,000,000, plus 10% VAT.
