Bermuda Employment Act 2000 Leave Entitlements
The Employment Act 2000 sets statutory minimum standards for paid vacation and parental leave for all employees in Bermuda:
Annual Vacation Leave (Section 15)
- Minimum Entitlement: At least two (2) weeks' paid vacation leave after completion of the first year of employment.
- Pro-Rata Accrual: Employees leaving service before completing a full leave year are entitled to paid encashment of unused pro-rata leave.
- Encashment: Vacation pay is calculated based on normal wages excluding discretionary bonuses.
Maternity & Paternity Leave (Section 16)
- Maternity Leave: 13 consecutive weeks total. If the employee has completed 1 continuous year of service, 10 weeks are fully paid by the employer (100% pay), and 3 weeks are unpaid.
- Paternity Leave: Qualified fathers / partners are entitled to 5 consecutive working days of paid leave upon birth or adoption.
- Sick Leave: Employees with 1+ year service are entitled to up to 8 paid sick days per year.
