Bermuda Employment Act 2000 Severance Rules

The Employment Act 2000 (Section 23) codifies the statutory severance allowance payable to employees in Bermuda upon termination of employment by reason of redundancy:

Severance Formula (Section 23)

  • Minimum Tenure: At least 1 year of continuous service required to qualify.
  • First 10 Years: Two (2) weeks' basic pay for each completed year of service.
  • Beyond 10 Years: Three (3) weeks' basic pay for each completed year beyond 10 years.
  • Statutory Cap: Maximum severance allowance is strictly capped at twenty-six (26) weeks' pay.

Notice & Tax Exemption

  • Notice Pay (Section 20): 1 week for weekly employees, 2 weeks for bi-weekly, and 1 full month for monthly-paid staff.
  • Tax Neutrality: Statutory redundancy payments are exempt from employee payroll tax under standard Revenue Department rulings.
  • Currency: BD$ 1.00 = US$ 1.00.
