Bermuda Real Estate Conveyance & Stamp Duty Rules
The Stamp Duties Act 1976 governs real estate conveyancing transactions in Bermuda. Stamp duty is progressive and levied on the fair market value or purchase price of the property:
Progressive Stamp Duty Bands
- First BD$ 100,000: 2.10% (BD$ 2,100)
- BD$ 100,001 to BD$ 500,000: 3.15% (Max BD$ 12,600)
- BD$ 500,001 to BD$ 1,000,000: 4.20% (Max BD$ 21,000)
- BD$ 1,000,001 to BD$ 1,500,000: 6.30% (Max BD$ 31,500)
- Portion over BD$ 1,500,000: 7.35%
- Customary Split: In Bermuda, it is standard commercial practice for the buyer and seller to each pay 50% of the conveyance stamp duty.
Mortgages & Non-Bermudian Licences
- Mortgage Stamp Duty: 0.525% on the first BD$ 400,000 of principal secured, and 1.05% on any amount exceeding BD$ 400,000.
- First-Time Bermudian Relief: First-time Bermudian homeowners purchasing a property for BD$ 750,000 or less receive a full stamp duty exemption.
- Non-Bermudian Licence Fee: Non-Bermudians purchasing property must obtain a license from the Ministry of Economy & Labour (8% fee for condos; 12.5% fee for stand-alone houses).
