BVI Leave & Maternity Statutory Provisions

Under the British Virgin Islands Labour Code 2010 and the Social Security Act, statutory worker benefits ensure protected paid leave and financial assistance during maternity.

Annual Vacation (Section 47)

Every employee is entitled to not less than 2 working weeks of paid annual holiday for each year of service. Vacation accumulates pro-rata monthly and must be remunerated at normal basic earnings.

Maternity Package (Section 50 & SSB)

Expectant mothers are guaranteed 13 weeks of job-protected maternity leave. Employers pay 100% salary for the first 6 weeks (for employees with 12+ months service). The Social Security Board pays 66.67% of insurable earnings for up to 13 weeks plus a $300 maternity grant.
