BVI Labour Code 2010 Severance Rules

Under Section 57 of the British Virgin Islands Labour Code 2010, an employee who has been continuously employed for not less than one year is entitled to redundancy severance pay if their employment is terminated due to redundancy, reorganization, or business cessation.

Statutory Severance Formula

1 week's basic remuneration for each completed year of continuous service with the same employer. Weekly pay is calculated basic remuneration divided by 52 (or monthly remuneration divided by 4.3333).

Notice of Termination (Section 53)

• Under 1 year of service: 2 weeks' notice.
• 1 year to 5 years: 1 month's notice.
• 5 or more years: 2 months' notice.
Failure to provide notice obligates payment in lieu of notice (PILON).
