What happens if an employee resigns voluntarily from a UDC contract? ▼
If an employee resigns voluntarily with proper notice, they do not receive seniority indemnity for the ongoing uncompleted semester, but they retain all semi-annual seniority indemnities already paid in previous periods, plus full compensation for accrued unused annual leave.
Can an FDC contract be renewed indefinitely? ▼
No. Under Article 67 of the Cambodian Labor Law, an FDC cannot have an initial duration of more than 2 years. If renewed or extended beyond a total cumulative duration of 2 years, it automatically converts by operation of law into a permanent UDC contract.
What are the statutory notice periods for UDC dismissal? ▼
Statutory notice periods under Article 75: 7 days for service under 6 months; 15 days for 6 months to 1 year; 1 month for 1 to 5 years; 2 months for 5 to 10 years; and 3 months for service exceeding 10 years.
