Can both parents take parental leave at the same time? ▼
Yes. Parents can take their parental weeks concurrently (at the same time) or consecutively (one after the other), total combined weeks do not exceed the statutory maximum (40 weeks for Standard or 69 weeks for Extended).
What is employer top-up and how does it affect EI? ▼
Many employers provide supplemental unemployment benefit (SUB) plans or 'top-up' payments to bridge the gap between EI benefits and the employee's regular salary (e.g. topping up to 80% to 100% of pay). Registered SUB plans do not reduce your weekly EI payments.
Can I work part-time while on parental leave? ▼
Under the 'Working While on Claim' rule, you can keep 50 cents of your EI benefits for every dollar you earn, up to 90% of your previous weekly insurable earnings. Any earnings beyond 90% are deducted dollar-for-dollar from your EI payment.
What happens if you switch from Standard to Extended leave midway? ▼
Service Canada strictly enforces that once you start receiving parental benefit payments, you cannot switch between the Standard and Extended options. The choice is permanent for that child's claim.
How soon can maternity leave start before the due date? ▼
Maternity leave can begin weeks before the expected date of delivery or the week in which the baby is born. Maternity benefits must be concluded within 17 weeks after the actual week of delivery.
