Frequently Asked Questions: Eritrea Annual Leave & Encashment

How many days of paid annual leave are workers entitled to in Eritrea?

Under Article 60 of the Transitional Labour Proclamation No. 118/2001, a worker who has completed one year of continuous service is entitled to an uninterrupted paid annual leave of 14 working days. The entitlement increases by 1 additional working day for every additional 2 years of continuous service, up to a statutory ceiling of 21 working days (or higher under individual collective agreements).

How is the daily wage calculated for unused leave cash settlement?

The statutory daily wage for annual leave encashment is calculated by dividing the employee's monthly basic salary by 26 working days (assuming a standard 6-day, 48-hour working week). For employees on a 5-day week, a 21.67 or 22-day divisor is applied.

Can an employee cash out annual leave while remaining employed?

No. Under Article 64, agreements to forfeit statutory annual leave in exchange for monetary compensation during ongoing employment are null and void. Annual leave is intended for worker health and recuperation. Cash encashment is legally permissible only upon termination or separation from employment.

How does pro-rata annual leave accrue for employees leaving mid-year?

An employee who terminates employment before completing a full 12-month annual cycle is entitled to pro-rata leave compensation proportional to the fraction of the year worked (accrued days = [months worked รท 12] ร— annual entitlement).

Can annual leave be accumulated or carried over into the next year?

Under Article 63, annual leave must generally be taken within the year of entitlement. However, by mutual written agreement between employer and employee due to operational requirements, leave may be postponed and accumulated for a maximum of two consecutive years.
