Fiji Statutory Leave Entitlements & ERA 2007 Guidelines
Section 54: Annual Holidays with Pay
Every worker in Fiji who completes 12 continuous months of service with an employer acquires an unalienable statutory right to at least 10 working days of paid annual leave. If employment terminates before completing 12 months (but after at least 3 months), the employee must receive pro-rata compensation calculated/6th of a working day for each completed month.
Section 33: Paid Sick Leave
After completing 3 months of continuous service, workers are entitled to 10 working days of paid sick leave each year. If the absence exceeds two consecutive working days, the employee is required to present a valid medical certificate issued by a registered medical doctor to receive paid sick benefits.
Section 101: 84 Days Maternity Leave
Female employees are entitled to 84 consecutive days (12 weeks) of paid maternity leave. The employer is legally obligated to pay normal wages throughout the maternity leave for the first three confinements, supporting maternal and newborn health without financial disruption.
Section 101A: Paternity & Bereavement
Fijian law guarantees 5 working days of paid paternity leave to male employees upon the birth of their child, allowing fathers to support mother and child. Additionally, Section 33A provides for 3 working days of paid bereavement leave upon the death of an immediate family member.
