Unlike statutory holidays or severance pay, the Employment Ordinance (Cap. 57) does not prescribe a universal statutory minimum overtime rate or standard working hours. Overtime compensation (e.g. 1.0x, 1.25x, 1.5x, or time-off in lieu) is determined by the contract of employment, employee handbook, or collective agreements.

What is the statutory requirement for Rest Days under Cap. 57? ▼

Under Section 17 of the Employment Ordinance, every employee employed under a continuous contract is entitled to not less than one (1) rest day in every period of seven (7) days. A rest day is defined continuous period of not less than 24 hours during which the employee is entitled to abstain from working.

Can an employer compel an employee to work on a statutory rest day? ▼

No. An employer must not compel an employee to work on a rest day, except in the event of an unforeseen breakdown of machinery or other emergency. If an employee works on a rest day, the employer must provide a substitute rest day within 30 days.

Are rest days paid or unpaid? ▼

Whether rest days are paid or unpaid depends on the agreed terms of the employment contract. In monthly-rated contracts, rest days are generally paid unless expressly specified in the contract.

How is the regular hourly wage rate calculated from a monthly salary? ▼
