Under the Maternity Benefit (Amendment) Act 2017, eligible female employees are entitled to 26 weeks (182 calendar days) of paid maternity leave for their first two surviving children (up to 8 weeks can be taken before the expected delivery date).

What is the leave entitlement for mothers with two or more children?

For women having two or more surviving children, the statutory paid maternity leave is 12 weeks (84 calendar days), with up to 6 weeks preceding the expected delivery date.

What is the minimum eligibility criteria to receive maternity benefit?

To qualify under Section 5(2) of the Act, a woman must have actually worked for an employer for a period of at least 80 days in the 12 months immediately preceding the date of her expected delivery.

How is the maternity benefit wage calculated?

The maternity benefit is paid at the rate of the woman average daily wage for the period of her actual absence. Average daily wage is calculated wages earned during the 3 months preceding absence divided by days worked.

What is the mandatory creche facility requirement?

Under Section 11A of the Act, every establishment with 50 or more employees must provide a creche facility within a prescribed distance, permitting the mother 4 visits daily.
