1. Mandatory 50% Rate for Over 60 Hours
Under the Work Style Reform Act (働き方改革関連法), the overtime rate for monthly hours exceeding 60 hours was increased to 50% (1.50x base wage). While previously delayed for small businesses, this 50% rate became mandatory for all employers across Japan on April 1, 2023.
Late-night hours (22:00 to 05:00) add an additional 25% premium, resulting in a 75% total premium (1.75x) for late-night hours past the 60-hour threshold.
2. Fixed Overtime Shortfall Protections (みなし残業差額)
"Minashi Zangyo" (fixed deemed overtime pay) is widely used in Japanese corporate contracts. However, if your calculated statutory overtime pay exceeds your monthly fixed allowance, your employer must immediately pay the difference in that month's payroll.
