Frequently Asked Questions: Jordan Labor Law Overtime Rules

How is an employee's hourly wage determined under Jordanian Labor Law? +

In accordance with Ministry of Labor administrative guidelines and Court of Cassation practice, the standard hourly wage for monthly salaried workers is computed based on 30 calendar days at 8 hours per day, giving a statutory monthly divisor of 240 hours:

Hourly Base Rate = Monthly Comprehensive Wage ÷ 240

If an employment contract specifically stipulates a 40-hour work week or 192 standard monthly hours, the agreed divisor may be used, increasing the base hourly rate.

What are the statutory overtime multipliers for regular days vs. holidays? +

Article 59 of Jordanian Labor Law No. 8 of 1996 establishes two distinct statutory overtime tiers:

  • Ordinary Working Days (المادة 59/أ): The worker receives their normal hourly wage plus a minimum 25% premium, totaling 125% (1.25×).
  • Weekly Rest Days and Official Holidays (المادة 59/ب): The worker receives not less than 150% (1.50×) of their regular remuneration for each hour worked.
Is overtime pay subject to Social Security Corporation (SSC) deductions? +

Under Social Security Law No. 1 of 2014, regular monthly social security deductions (7.5% employee, 14.25% employer) are assessed on the worker's registered fixed contractual wage. Fluctuating overtime payments that vary from month to month are generally excluded from monthly SSC contribution calculations, unless contractual allowances are permanently restructured.

Can an employer mandate overtime without the employee's consent? +

Generally, overtime requires mutual consent. However, Article 57 of the Labor Law provides limited exceptions where employers may require overtime without prior agreement: (1) conducting annual inventory, account closing, or preparation for sales discounts; (2) preventing substantial work accidents or remedying their consequences; and (3) avoiding inevitable loss of perishable raw materials. Such emergency overtime is capped at 30 days per calendar year.

Are managerial employees entitled to statutory overtime in Jordan? +

Under Article 58, provisions governing standard working hours and overtime (Articles 56, 57, and 59) do not apply to employees who exercise general supervisory or administrative authority over a department or the establishment, or whose work requires traveling outside the enterprise.
