1. Statutory 1.5x Premium Floor

Under Articles 108–110 of the Labor Code, employers cannot contractually lower overtime or night work premiums below the 1.5x statutory minimum. Any contract clause purporting to pay standard 1.0x for overtime is legally void.

Night work (22:00–06:00) entitles the employee to an additional 50% premium on top of regular salary for every night hour worked.

2. Mandatory Annual Limits

Overtime cannot exceed 2 hours per shift (or 1 hour in hazardous conditions) and is strictly capped at 12 hours per calendar month and 120 hours per calendar year.

Violations of overtime caps are penalized under Article 89 of the Administrative Violations Code of Kazakhstan with fines up to 100 MRP for enterprises.
