How is statutory maternity leave (Pushimi i Lehonise) structured in Kosovo?

Under Article 49 of Kosovo Law on Labour No. 03/L-212, employed women are entitled to twelve (12) months of statutory maternity leave: (1) First six (6) months: Paid by the Employer at 70% of the employee's basic salary; (2) Next three (3) months (Months 7, 8, and 9): Paid by the Government of Kosovo at 50% of the average wage in Kosovo (statutory cap ~€170 to €250/mo); (3) Final three (3) months: Unpaid leave.

When can a pregnant employee begin maternity leave in Kosovo?

Under Article 49(2), an employee can begin maternity leave up to forty-five (45) days before the expected delivery date based on a medical practitioner's certificate, and must mandatorily commence leave at least twenty-eight (28) days prior to delivery.

Can the father take parental leave in place of the mother in Kosovo?

Yes. Under Article 50 of the Law on Labour, if the mother returns to work before exhausting the second phase of leave, the father has the statutory right to assume the remaining portion of maternity and parental leave under identical rights.

What is the statutory paternity leave entitlement for fathers in Kosovo?

Under Article 50(1), the father is entitled to three (3) days of fully paid paternity leave upon the birth of a child, paid directly by the employer, as well as two (2) weeks of unpaid parental leave.
