What is the statutory annual leave entitlement under Kuwait Labor Law?

Under Article 70 of Kuwait Labor Law No. 6 of 2010 (Private Sector), every worker who has completed at least nine continuous months of service with an employer is entitled to 30 working days of fully paid annual leave per year.

How is the daily wage rate calculated for annual leave encashment in Kuwait?

Under Article 55 and standard Ministry of Social Affairs and Labor (MOSAL / PAM) jurisprudence, daily wage for monthly salaried employees is calculated using a statutory divisor of 26 working days: Daily Wage = Monthly Basic Remuneration ÷ 26.

Are official public holidays or sick leaves counted against annual leave days?

No. Article 70 explicitly provides that official public holidays and documented sick leaves occurring during an employee's annual leave period are not counted as part of annual leave and must be added back to the worker's entitlement.

Can an employer force an employee to forfeit accrued annual leave upon resignation?

No. Article 71 dictates that upon termination or resignation of employment, the employee is entitled to full cash compensation (encashment) for all accrued, untaken annual leave days computed on the basis of their final salary.

Can annual leave be accumulated across consecutive years in Kuwait?

Under Article 72, with the written consent of both parties, annual leave may be accumulated for a maximum of two consecutive years. However, leave days must be taken or settled in cash without indefinite accumulation.
