What is the statutory notice period for terminating an employment contract in Kuwait?
Under Article 44 of Kuwait Labor Law No. 6 of 2010, for open-ended (indefinite) contracts, either party wishing to terminate the contract must provide a minimum written notice of three (3) months prior to termination for monthly salaried workers.
What compensation is owed if the employer terminates without observing the 3-month notice?
Under Article 44, if the employer terminates the employee immediately without giving the full 3-month written notice, the employer is legally obligated to pay a notice compensation (badal inthar) equal to the worker's full monthly salary for the entire 3-month notice period or remaining notice balance.
