What is the statutory duration of maternity leave in Kyrgyzstan?
Under Article 307 of the Labor Code of the Kyrgyz Republic, working women are entitled to 126 calendar days of paid pregnancy and maternity leave (70 calendar days before delivery and 56 calendar days after delivery). In cases of complicated childbirth or multiple births, postnatal leave is extended to 70 days (total 140 calendar days).
Who pays for maternity leave in Kyrgyzstan?
Under the Law on State Benefits: the employer pays for the first ten (10) working days of maternity leave at 100% of the employee's average daily wage. Starting from the 11th working day, maternity benefits are funded by the state republican budget through the Ministry of Labor, Social Security and Migration.
How is the state-funded portion from the 11th day calculated?
The state benefit from the 11th working day is tied to the statutory calculation index (расчетный показатель - 100 KGS, or sector multiplier). In standard regional practice, the monthly benefit corresponds to 10 to 20 calculation indices depending on whether the woman resides in high-altitude zones.
Is an employee entitled to additional unpaid parental leave?
Yes. Under Article 308 of the Labor Code, upon completion of maternity leave, a working mother (or father/guardian) may take unpaid childcare leave until the child reaches three (3) years of age, with complete retention of their job position.
Can an employer dismiss a pregnant employee in Kyrgyzstan?
No. Article 310 of the Labor Code strictly prohibits the dismissal of pregnant women or women with children under three years of age at the initiative of the employer, except in cases of complete enterprise liquidation.
