Under Article 86 of the Labor Code of the Kyrgyz Republic, upon termination due to liquidation of the enterprise or reduction in staff/workforce, the employer is legally obligated to pay a severance benefit (выходное пособие) of not less than one average monthly salary upon dismissal.
How does wage preservation during job search work under Article 86?
Article 86 dictates that the employee's average monthly salary is preserved during the job search period for up to two (2) months (inclusive of the 1-month severance pay). In exceptional cases, it is preserved for a third (3rd) month if the employee registered with the State Employment Service within 10 calendar days after dismissal and was not placed in employment.
