What are the statutory overtime pay rates under Lao Labor Law?

Under Article 53 of Lao Labor Law No. 43/NA, overtime compensation is categorized: daytime overtime on regular workdays (17:00 to 22:00) is paid at 150% of the hourly rate; night overtime (22:00 to 06:00) is paid at 200%; daytime overtime on weekly rest days or public holidays is paid at 250%; and night overtime on rest days or public holidays is paid at 300% (triple pay).

How is the hourly wage rate calculated in Laos?

Under standard Ministry of Labor regulations, hourly rate for monthly salaried workers is derived based on 26 working days per month and 8 hours per day: Hourly Rate = Monthly Basic Wage ÷ (26 × 8) = Monthly Basic Wage ÷ 208 hours.

What are the statutory working hours in Laos?

Under Article 51 of the Labor Law, standard working hours cannot exceed 8 hours per day or 48 hours per week. For hazardous, toxic, or underground occupations, standard hours cannot exceed 6 hours per day or 36 hours per week.

What is the statutory limit on overtime work per month?

Under Article 52, overtime work must not exceed 45 hours per month or an average of 3 hours per day, except in exceptional emergencies or natural disaster recovery.

Can overtime compensation be replaced with time off in lieu in Laos?

No. Overtime pay must be paid in cash in the payroll period in which the overtime work was performed, and cannot be forfeited or forced into unpaid compensatory leave.
