What is the statutory annual leave entitlement in Latvia?
Under Section 149 of the Latvian Labor Law (Darba likums), every employee is entitled to annual paid leave of not less than four (4) calendar weeks (20 working days for a standard 5-day work week, or 24 working days for a 6-day work week), excluding official public holidays.
How is the average daily wage calculated for leave pay in Latvia?
Under Section 75, average daily earnings are derived by dividing the employee's total gross remuneration (basic salary + bonuses) paid in the preceding six (6) calendar months by the actual number of days worked during that six-month period.
What compensation is legally required for working on official public holidays?
Under Section 144 and 68 of the Labor Law, work performed on official public holidays (svētku dienas) must be compensated at a supplement of not less than 100% of the employee's hourly or daily wage rate (double pay), or compensated with equivalent paid time off upon mutual agreement.
Is it legal to encash unused annual leave during ongoing employment?
No. Section 149(5) strictly dictates that reimbursement of annual paid leave with monetary compensation is prohibited during ongoing employment. Encashment is legally permissible ONLY upon the termination of the employment contract for all accrued, unutilized leave days.
Can unused annual leave days be carried forward into the next year?
Under Section 149(3), in exceptional circumstances where granting full leave would disrupt normal business operations, part of the leave may be transferred to the subsequent calendar year with the employee's written consent, provided that at least two consecutive weeks are utilized in the current year.
