What are the statutory notice periods under Article 50 of the Lebanese Labor Code?
Under Article 50, mandatory notice periods before termination are determined by length of continuous service: 1 month for service under 3 years; 2 months for service between 3 and 6 years; 3 months for service between 6 and 12 years; and 4 months for service exceeding 12 years.
What constitutes arbitrary or unfair dismissal (الصرف التعسفي) in Lebanon?
Arbitrary dismissal occurs when an employer terminates an employee without legitimate economic, technical, or conduct-related cause, or due to personal beliefs, union activity, marriage, pregnancy, or exercising legal rights.
How much compensation is awarded for unfair dismissal in Lebanon?
Under Article 50(d), the Labor Arbitration Council (مجلس العمل التحكيمي) awards compensation ranging between two (2) and twelve (12) months of the employee’s last gross monthly salary, based on length of service, age, personal circumstances, and extent of damages suffered.
Can notice be substituted with pay in lieu of notice in Lebanon?
Yes. Either party failing to observe the mandatory statutory notice period must pay the other compensation equal to the employee’s full remuneration for the duration of the unserved notice period.
Does arbitrary dismissal compensation replace End-of-Service Indemnity?
No. Damages awarded for arbitrary dismissal are cumulative and paid in addition to accrued annual leave encashment and statutory CNSS End-of-Service Indemnity.
