❓ الأسئلة القانونية والضريبية الشائعة (FAQ)

How is End-of-Service Indemnity calculated under Libyan Labor Law No. 12 of 2010?

Under Article 78 of Law No. 12/2010, an employee who is not covered by social security pension provisions or who departs upon contract termination is entitled to end-of-service indemnity: half a month’s wage (15 days) for each of the first five (5) years of service, and one full month’s wage (30 days) for each subsequent year of service.

What wage components are included in the indemnity calculation in Libya?

The calculation is based on the employee’s last received monthly gross basic wage, including permanent statutory cost-of-living allowances.

Are partial years of service entitled to pro-rata indemnity in Libya?

Yes. Fractions of years worked beyond completed years are calculated on a strictly proportional pro-rata basis: (Completed Months / 12) × Entitled Monthly Wage Fraction.

Does an employee who resigns voluntarily receive end-of-service indemnity?

Under Libyan labor practice, an employee resigning voluntarily is entitled to a portion of the indemnity: one-third if service is between 2 and 5 years, two-thirds if service is between 5 and 10 years, and full indemnity if service exceeds 10 years.

Is end-of-service indemnity forfeited in cases of dismissal for misconduct?

Yes. If an employee is dismissed for grave disciplinary causes listed under Article 77 of Law No. 12/2010 (such as embezzlement, assault, or disclosing trade secrets), statutory end-of-service indemnity is forfeited.
