Under Article 70 of Libyan Labor Relations Law No. 12 of 2010, contracts of indefinite duration require at least thirty (30) days prior written notice before termination, or payment of full salary in lieu of notice.

What constitutes arbitrary or unfair dismissal (الفصل التعسفي) in Libya?

Under Article 73, dismissal is considered legally arbitrary if executed without legitimate cause relating to the worker’s conduct or capacity, or due to union activities, submitting a complaint, gender, or social status.

What compensation does a Libyan labor court award for unfair dismissal?

Under Article 74, if the competent court establishes arbitrary dismissal, it may award the worker compensation ranging from six (6) to twelve (12) months of their last gross monthly salary, in addition to notice pay and end-of-service gratuity.
