Mauritius Leave Regulations: Legal Rights & Statutory Limits

1. Continuous Service Accrual

Leave days accrue at the statutory rate of 1.83 working days per completed month of service, reaching the full 22-day quota after completing 12 consecutive months with the same employer.

2. Sickness Certification

Under Section 28, a worker who is absent due to illness for more than 3 consecutive working days must produce a certified medical certificate from a registered practitioner to claim full sick leave wages.

3. Mandatory Encashment

Any accrued annual leave remaining untaken at the time of contract termination, redundancy, or retirement cannot be forfeited and must be encashed in full at the statutory daily rate.
