Workers' Rights Act 2019: Annual Leave, Sick Leave & Gratuity Mandates

1. Annual Leave Rights

Employees are entitled to 20 days (5-day week) or 22 days (6-day week) of paid annual leave. The worker may take up to 2 days of annual leave without prior authorization for urgent personal contingencies.

2. Sick Leave Rules

Workers receive 15 days (5-day week) or 21 days (6-day week) of paid medical sick leave annually. A medical certificate is required if sick leave exceeds 3 consecutive days.

3. Leave Encashment

Where accrued annual leave is not taken by agreement at the expiration of the entitlement period, it must be encashed at the normal basic daily remuneration (calculated using the 26-day monthly divisor).
