Montserrat Redundancy & Severance Regulations

Under the Montserrat Employment Act, an employee whose contract is terminated by reason of redundancy after continuous service of one year or more is entitled to statutory severance pay.

Statutory Severance Formula

An employee receives 1 week's basic wage for each completed year of service. Weekly pay is computed as annual remuneration divided by 52 (or monthly salary divided by 4.3333).

Notice of Termination

• Under 1 year: 2 weeks' notice.
• 1 to 5 years: 1 month's notice.
• Over 5 years: 2 months' notice.
Employers must provide statutory notice or equivalent payment in lieu (PILON).
