Statutory Severance Rules in Nicaragua (Art. 45 Ley 185)

Under Article 45 of the Codigo del Trabajo (Ley 185), when an employer terminates an indefinite employment contract without cause:

Seniority Compensation Scale

  • Years 1, 2 & 3: 1 full month of salary for each completed year.
  • Year 4 and Beyond: 20 days of salary (20/30 = 0.667 of a month) for each additional year.
  • Fractions of years are compensated proportionally in days and months.

Mandatory 5-Month Ceiling (Tope Maximo)

  • The total indemnity under Art. 45 can never exceed five (5) months' salary, regardless of whether the employee served 6 years or 30 years.
  • This statutory ceiling reaches 5.0 months at exactly 6 continuous years of service (3 yrs = 3 mos + 3 yrs @ 20 days = 2 mos → total 5 mos).
