Niue Amendment Act 1968 Customary Land Law
Under the Niue Amendment Act 1968 administered by the High Court of Niue (Land Division):
- Inalienable Customary Land: All land in Niue is customary Niuean land held collectively by the Magafoa (family kin group) and cannot be sold in fee simple. Only leasehold agreements for up to a statutory maximum of 60 years are permitted.
- Leveki Magafoa Consent: Lease agreements must receive the formal consent of the Leveki Magafoa (family trustee) and all confirmed family co-owners.
- High Court Land Division Approval: Every lease must be confirmed and registered by the High Court Land Division to be legally binding and enforceable.
