Overtime Regulations in Peru (D.S. 007-2002-TR)

Under Decreto Supremo N° 007-2002-TR (Texto Único Ordenado de la Ley de Jornada de Trabajo, Horario y Trabajo en Sobretiempo):

First 2 Hours (+25%)

The first two overtime hours performed on any given working day are remunerated with a 25% surcharge over the ordinary hourly rate (1.25x).

3rd Hour & Beyond (+35%)

For the third hour of overtime and every subsequent extra hour logged on that same day, the surcharge increases to 35% (1.35x).

Sundays & Holidays (+100%)

Working on a weekly rest day (Sunday) or non-working national public holiday without replacement compensatory time off entitles the worker to triple pay (regular daily pay + 100% surcharge).
