What is the difference between Redundancy and Retrenchment? Under Article 298 of the Labor Code, redundancy exists when the service capability of the workforce is in excess of what is reasonably needed by the enterprise (e.g. overhiring, duplication of functions), warranting one (1) month pay per year of service. Retrenchment is an economic ground to prevent ongoing or imminent business losses, where the law allows a lower severance of one-half (1/2) month pay per year of service.

What is the minimum separation pay? Under no circumstance can separation pay under authorized causes be less than one (1) full month's pay, even if the employee has served for less than one year (provided they served for at least six months).

Is voluntary resignation entitled to separation pay? As a general rule under Philippine labor jurisprudence, an employee who voluntarily resigns is not entitled to separation pay, unless it is expressly stipulated in the employment contract, collective bargaining agreement (CBA), or has become an established and uninterrupted company practice.
