Paid Leave & Maternity Provisions in Saint-Martin
In the French Collectivity of Saint-Martin, statutory holiday rights are established by the Code du travail and healthcare entitlements are financed by the CGSS de la Guadeloupe.
1. Annual Paid Leave (*Conges Payes*)
Under Article L3141-3, all employees acquire 2.5 working days (*jours ouvrables*) of paid vacation for each month of actual service, equating to 30 working days (5 calendar weeks) per reference year (June 1 to May 31). Employers must compare two statutory methods and disburse whichever yields the greater amount:
- 1/10th Rule (*Regle du dixieme*): 10% of all gross compensation earned throughout the reference year.
- Salary Maintenance Rule (*Regle du maintien de salaire*): Exact salary the employee would have earned had they remained at work during the vacation period.
2. CGSS Maternity Leave (*Conge Maternite*)
Under Article L1225-17, maternity leave durations are strictly protected:
- 1st or 2nd Child: 16 weeks (6 prenatal + 10 postnatal).
- 3rd Child or Subsequent: 26 weeks (8 prenatal + 18 postnatal).
- Twins: 34 weeks; Triplets+: 46 weeks.
CGSS pays daily maternity allowances (*indemnites journalieres*) based on average wages up to the French social security ceiling (PMSS).
3. Paternity Leave (*Conge de Paternite*)
Fathers or second parents are entitled to 28 consecutive calendar days of paternity leave (3 mandatory days paid 100% by the employer upon birth + 25 days compensated by CGSS Guadeloupe).
