Statutory Framework & Calculation Rules
Statutory Redundancy Provisions (Zakon o radu, Član 158):
• Eligibility: Applies to employees terminated due to technological, organizational, or economic changes (*Tehnološki višak*).
• Statutory Minimum Severance: Cannot be lower than one-third (1/3) of the employee's average gross salary paid in the last three (3) months for each full year of service with the employer.
• No Maximum Statutory Cap: Serbian Labor Law does NOT cap the total severance payout (unlike jurisdictions that cap at 6 salaries).
• Tax-Free Threshold: Severance paid up to the statutory minimum is 100% exempt from personal income tax and social security contributions.
• Unused Paid Vacation: Must be fully compensated at the average daily wage.
