Statutory Overtime Rules in Sint Maarten

According to the Arbeidsregeling Sint Maarten overseen by the Department of Labor:

  • Standard Work Week: 40 hours per week for commercial and office personnel; maximum 45 hours in hospitality, casino, and hotel continuous operations.
  • Weekday Overtime (150% / 1.5x): Hours worked in excess of normal daily working hours on standard workdays require a minimum premium of 150%.
  • Sunday / Scheduled Rest Day (200% / 2.0x): Work performed on a scheduled weekly rest day or Sunday requires a minimum rate of 200% (double time).
  • Official Public Holidays (250% / 2.5x): Work performed on statutory holidays is compensated at 250% of the employee's regular hourly wage.
