Slovak Labor Code Annual Leave Provisions (§ 101 - 122)
Vacation and statutory holiday work compensation in Slovakia are strictly defined by statutory protections:
- 5-Week Leave Entitlement (§ 103 ods. 2): Employees who reach at least 33 years of age by the end of the relevant calendar year, OR who are permanently caring for a child, are legally entitled to at least 5 weeks of annual leave (25 working days). Basic leave for other employees is 4 weeks (20 days). Teachers and academics receive 8 weeks (40 days).
- Leave Buyout Prohibition (§ 116): Payment in lieu of annual leave is prohibited while employment continues. Vacation compensation can be paid out solely when an employee cannot take leave due to the termination of their employment contract.
- 100% Public Holiday Surcharge (§ 122): Employees working on any of Slovakia's 15 statutory public holidays are entitled to their agreed regular wage PLUS a wage surcharge of at least 100% of their average hourly earnings, unless the employer and employee agree on compensatory paid time off.
