Pursuant to Section 38(7) of the Labour Act 2017, an agreement by an employee to relinquish the right to annual leave in exchange for monetary compensation during employment is void, except upon termination of the contract.
Statutory Annual Leave Provisions (Section 38)
- Statutory Minimum: At least 21 working days of annual leave with full pay for every continuous 12 months of service.
- Pro-Rata Rule: Employees who have served for less than a full year are entitled to pro-rata paid leave at the rate of 1.75 days per month of service.
- Public Holidays Excluded: Gazetted public holidays and recognized rest days that coincide with the leave duration shall not be counted as part of the annual leave.
- Termination Encashment: Upon separation, any accrued leave not taken must be paid out in cash based on the employee's standard daily wage.
