Under Section 42(4), it is unlawful for an employer to dismiss a female worker during maternity leave or on grounds related to pregnancy or family responsibilities.
Key Statutory Maternity & Paternity Provisions (Labour Act 2017)
- Maternity Leave Duration: Female workers are entitled to not less than 90 consecutive calendar days of maternity leave with full wages.
- Extension for Medical Reasons: In the event of pregnancy-related illness or post-partum complications certified by a medical doctor, leave may be extended up to an additional 30 days.
- Daily Nursing Rights: Mothers returning to work are entitled to 2 hours of paid nursing breaks per working day for up to 12 months after giving birth.
- Paternity Leave: Male employees are entitled to 10 working days of fully paid paternity leave following the birth of their child.
