Parental Leave Equality in Spain
Spain is an international leader in equal parental rights. Under Royal Decree-Law 6/2019, maternity and paternity leaves were unified into the single Permiso por nacimiento y cuidado del menor:
- Equal 16 Weeks: Both the biological mother and the other parent receive 16 weeks of 100% paid leave.
- Mandatory First 6 Weeks: The first 6 weeks must be taken full-time immediately after birth. The remaining 10 weeks can be enjoyed continuously or in weekly blocks until the child turns 12 months.
- Exempt from IRPF: Per Supreme Court Ruling 1462/2018, all parental benefits paid by the INSS are 100% exempt from Personal Income Tax.
