Shop & Office Employees Act (SOEA) Overtime Regulations

Under the Shop and Office Employees (Regulation of Employment and Remuneration) Act of Sri Lanka, statutory working conditions for executive, clerical, supervisory, and retail employees are strictly codified:

Parameter Statutory Standard Legal Provision
Normal Working Hours 8 hours per day / 45 hours per week Excludes lunch/tea intervals of at least 1 hour daily
Overtime Rate 1.5 times the regular hourly rate Hourly rate = Monthly Basic Salary รท 200
Maximum Overtime Cap 12 hours per week maximum Employers cannot compel employees beyond 12 hours weekly
Full Moon Poya Days 1.5x pay or alternate paid holiday Mandatory paid non-working day under Holidays Act
Mercantile Holidays 2.0x pay or normal pay + 1 paid day off Applies to statutory mercantile public holidays

Why is the Divisor 200 Hours?

Under SOEA regulations, an employee works approximately 45 hours per week. In a month (averaging 4.33 weeks), standard working time is roughly 195 hours. The Department of Labour and judicial precedent establish the statutory monthly divisor as 200 hours for computing hourly wage rates from monthly salaries.
