Tanzania Annual Leave Legal Framework

Annual leave entitlements are safeguarded under Section 31 of the Employment and Labour Relations Act, 2004.

1. 28 Consecutive Days

Tanzanian law guarantees a generous statutory baseline of at least 28 consecutive days paid leave (inclusive of public holidays falling within the period) per 12-month leave cycle.

2. Timing of Leave

Leave must be granted by agreement between employer and employee at any time within 6 months following the end of the leave cycle to prevent worker fatigue.

3. Termination Encashment

Upon resignation, dismissal, or contract expiry, Section 31(8) mandates the employer to pay the employee pro-rated remuneration for any untaken accrued leave.

4. Full Wage Protection

An employer must pay the employee their full ordinary remuneration during annual leave prior to the commencement of the leave period.
