Tanzania Maternity & Paternity Legal Framework
Parental protections in Tanzania are established under Part III, Subpart B of the Employment and Labour Relations Act, 2004 (ELRA) and the National Social Security Fund (NSSF) Maternity Benefit Rules.
1. Full Salary Protection
Unlike jurisdictions where state funds replace only a portion of wages, Section 33 mandates Tanzanian employers to pay the employee's full ordinary remuneration during the entire 84 or 100 days period.
2. The 3-Year Interval Rule
An employee is entitled to maternity leave up to four times during employment with the same employer, provided that each subsequent leave occurs at least 36 months (3 years) after the previous birth.
3. 3-Day Paternity Leave
Section 34 grants working fathers at least 3 paid calendar days in every 36-month leave cycle, which must be taken within 7 days immediately following the child's birth.
4. Daily Nursing Feeding Time
Section 33(10) entitles nursing mothers who return to work to take up to two hours daily during working hours for breastfeeding or child feeding, for up to 6 months after birth, with zero wage deductions.
